Wrongful Death Lawsuit Filed Against Revitalize Health & Wellness

Overview

An Odessa man, his mother-in-law, and his late wife’s former partner have filed a wrongful death lawsuit against Revitalize Health & Wellness and a registered nurse. The lawsuit alleges that Revitalize and the nurse provided substandard care, resulting in the death of the patient, Ashly Flores.

At that time, Colorado administered a rapid infusion of at least 951 cubic centimeters to Flores in less than 30 minutes, resulting in Flores suffering a seizure and cardiac arrest. She was transported to the Medical Center Hospital, where she died a few hours later.

According to the lawsuit filed in Ector County District Court, the death certificate lists fluid overload and rapid infusion of intravenous solution as the cause of death. Palma, Acosta, and Ginia Rivera Flores, Flores’ mother, allege that Revitalize “violated the duty of care it owed to Ashly Flores” and that Colorado “violated the standard of care she owed” Flores.

Negligent Care

The lawsuit asserts that the nurse did not properly assess or observe Flores during the infusion, did not ask her about any pre-existing medical conditions or medications she was taking, and did not determine the appropriate rate of infusion. Furthermore, the nurse allegedly did not render “timely and appropriate medical treatment” to Flores to stop the infusion.

Punitive and Compensatory Damages Sought

The plaintiffs in the case, Palma, Acosta, and Flores’ mother, are seeking unspecified punitive and compensatory damages on their own behalf and on behalf of Flores’ two youngest children and the child she shared with Acosta.
